Bitcellar, Inc. (hereinafter referred to as “Bitcellar”), in providing services managed by Bitcellar (including “Cellar”, “FxCamera” and services that may be managed by Bitcellar hereafter; hereinafter referred to as the “Services”), understands the protection of personal information is important, shall observe the Personal Information Protection Law of Japan (hereinafter referred to as the “Personal Information Protection Law”), other laws, regulations and guidelines related to the protection of personal information and shall make efforts to properly manage and protect personal information.
In this Privacy Policy, “Personal Information” means information which is defined in Article 2, Paragraph 1 of the Personal Information Protection Law, that is, information related to a living individual and by which a specific individual can be identified, such as name or date of birth (including information that can be easily analyzed with other information so that a specific individual can be identified).
Bitcellar may use a user’s Personal Information for the following purposes:
Bitcellar may change the purpose of the use of Personal Information if the changed purpose is within a scope reasonably related to the purpose before the change. In the event of any change in the purpose of the use of Personal Information, Bitcellar shall publicly announce or notify the users of the changed purpose.
Without obtaining the prior consent of the user, Bitcellar shall not handle Personal Information beyond the scope necessary to achieve the purpose of the use of Personal Information, except in the cases permitted pursuant to the Personal Information Protection Law or other laws and regulations; provided, however, that this shall not apply to the following cases:
Bitcellar shall acquire the Personal Information appropriately, and shall not acquire Personal Information by deception or other wrongful means.
Bitcellar shall conduct necessary and appropriate supervision over the employees of Bitcellar in order to prevent the risk of the loss, destruction, defacing or divulgation of Personal Information, and to ensure the security control of the Personal Information. In cases where Bitcellar entrusts an individual or a business operator with the handling of Personal Information, in whole or in part, Bitcellar shall conduct necessary and appropriate supervision over such party to ensure the security control of the Personal Information.
Bitcellar shall not provide Personal Information to a third party without obtaining the prior consent of the user, except in the cases permitted pursuant to the Personal Information Protection Law or other laws and regulations; provided, however, that this shall not apply to the following cases:
In cases where a user requests Bitcellar to disclose his/her Personal Information in accordance with the Personal Information Protection Law, Bitcellar shall disclose the Personal Information without delay after confirmation of the identification of the user (if the relevant Personal Information doesn’t exist, Bitcellar shall notify the user to that effect); provided, however, that this shall not apply to cases where Bitcellar shall not have a disclosure obligation under the Personal Information Protection Law or other laws and regulations. The user hereby agrees that the user shall pay to Bitcellar any costs incurred by Bitcellar for the disclosure of the Personal Information (one thousand Japanese yen per a disclosure).
In cases where a user requests Bitcellar to correct, add or delete (hereinafter referred to as the “Correction, etc.”) his/her Personal Information in accordance with the Personal Information Protection Law, due to the inaccuracy of such Personal Information, Bitcellar shall, after confirming the identity of the user and to the extent necessary to achieve the purpose of use of the Personal Information, conduct any necessary investigation without delay , make any necessary Correction, etc. to the Personal Information based on the results of the investigation and notify the users to that effect ( if Bitcellar decides not to make any Correction etc., Bitcellar shall notify the users to that effect.); provided, however, that this shall not apply to cases where Bitcellar shall not have any obligation to make any Correction etc. under the Personal Information Protection Law and other laws and regulations.
In cases where a user requests Bitcellar to suspend the use of or to delete his/her Personal Information in accordance with the Personal Information Protection Law on the ground that the Personal Information is being handled beyond the scope necessary for the achievement of the purpose of use of the Personal Information public announced in advance or that the Personal Information was acquired by deception or other wrongful means, Bitcellar shall, after confirming the identifying of the user and only when Bitcellar deems the request reasonable, suspend the use of or delete the Personal Information without delay and notify the user to that effect; provided, however, that this shall not apply to cases where Bitcellar shall not have any obligation to suspend or delete under the Personal Information Protection Law and other laws and regulations.
Cookies and other similar technologies may be used in the Services. These technologies contribute to understanding the status of utilization of the Services and to improving the Services. If the user wants to disable Cookies, the user can do so by changing the settings of his/her web browser; provided, however, if the user disables Cookies, the user may not be able to use the Services in whole or in part.
Bitcellar records information on persons who visit the website of Bitcellar in the form of access logs. Access logs include information such as the IP address, host name, kind of OS and web browser and access date and time. Bitcellar may use access logs to administer maintenance of the website of Bitcellar and the Services or for statistical analysis of the status of utilization.
Bitcellar shall not browse the photographic data, etc. which is stored by the users through the Services, disclose or provide it to a third party for the purpose of advertisements, etc., except in cases permitted pursuant to applicable laws and regulations, guidelines or the terms of the Services.
The Services can be connected to or linked with external services managed by third parties by the consent of the user. Information provided to the external services by the user is not under the management of Bitcellar, and the terms and privacy policy of the external services shall apply to such information separately from the terms of the Services and this Privacy Policy.
Bitcellar shall encrypt data using SSL as a rule, when the user sends or receives data of the user such as a credit-card number, password or digital data of a photograph, and when Bitcellar stores such data of the user. Bitcellar shall make efforts to improve the security of such data continuously, however Bitcellar shall not ensure complete security for the users.

当社は、お客様から、お客様の個人情報が、あらかじめ公表された利用目的の範囲を超えて取り扱われているという理由又は偽りその他不正の手段により取得されたものであるという理由により、個人情報保護法の定めに基づきその利用の停止又は消去（以下「利用停止等」といいます。）を求められた場合において、そのご請求に理由があることが判明した場合には、お客様ご本人からのご請求であることを確認の上で、遅滞なく個人情報の利用停止等を行い、その旨をお客様に遅滞なく通知します。但し、個人情報保護法その他の法令により、当社が利用停止等の義務を負わない場合は、この限りではありません。

お客様が、クレジットカード番号、パスワード、写真のデジタルデータなどのお客様のデータを送受信する場合並びに当社がそうしたお客様のデータを保管等する場合、当社は、原則としてSSL技術を使用してデータを暗号化します。当社は、こうしたデータに対するセキュリティについて継続的な改善に努めるものとしますが、お客様に対して完全なセキュリティを保証するものではありません。
